A Melbourne mum found with a bottle of booze in her lap after smashing through her neighbour’s fence claims something told her to drive, a court has heard.
Rebecca Majak pleaded guilty in Sunshine Magistrates’ Court on Thursday to careless driving, driving unlicensed and refusing to comply with a police direction for breath analysis.
The court heard the Sunshine West mother of six had gotten into her boyfriend’s car just before midnight on May 1 last year shortly before driving through her neighbours fence, causing “significant” damage.
When emergency services arrived, the 44-year-old was in the driver’s seat with the engine still running and an open bottle of liquor between her legs.
Police at the scene alleged she smelt of alcohol but Majak maintained she had drunk after the crash because she was stressed.
She refused to submit to a breath test after she was warned of the potential consequences and police checks revealed she was unlicensed.
The court heard she had a prior conviction for drink driving where she was disqualified for 20 months.
Majak, who arrived from Sudan about 10 years ago, required an interpreter and was supported by her uncle in court.
She broke down in tears and explained she was drinking because of stress and at the time of the crash she was totally confused.
She explained she was lying down at home before the crash but something told her to drive.
Magistrate Peter Reardon accepted she was highly stressed but there was no excuse and said it was clear after seeing photos of the crash that she was not fit to drive.
Mr Reardon said it was “fortunate” no one was killed or injured.
Majak was convicted and fined $1500.
Her licence was cancelled and disqualified for four years.
