A teenager charged in relation to a terrifying after-school brawl that left a student dead at suburban railway station has asked a court to sentence him to a youth justice facility.

Ngor Dao, 19, pleaded guilty in the Melbourne Magistrates’ Court in November last year to charges of affray and intentionally causing injury and appeared for a further plea hearing in County Court on Wednesday.

Dao, of Burnside Heights, took part in a fight that claimed the life of 16-year-old Staughton College student Pasawm Lyhym after he was stabbed to death on May 18, 2023.

The killer — a 17-year-old boy who pleaded guilty in the Supreme Court in August to a charge of murder — chased down and stabbed Pasawm with a knife in the back in broad daylight in retribution for a “slight” against his mate.

Pasawm tried in vain to block his killer with a shopping trolley during the horror attack which was witnessed by children heading home from school.

Dao — one of four teenage boys charged over the attack — is the only accused who can legally be identified because he was an adult at the time of the offence.

Two 17-year-olds have been dealt with in the children’s court.

During further plea hearing on Wednesday, defence lawyer Daniel Sala submitted that a youth justice facility would be an appropriate sentence given Dao’s age and steps for rehabilitation if the court ruled out community corrections order.

Mr Sala said the offending was out of character for Dao and he has not reoffended since charges were laid.

Dao will be sentenced on October 29.

As part of his bail, Dao has been ordered not to associate with any of his co-accused, not contact witnesses and be subject to a curfew between 11pm and 7am.
