A drunk Melton man who crashed into a tree on a late night food run was carrying a knife for “whatever might be going on”, a court has heard.
Leigh William Devlin pleaded guilty at the Sunshine Magistrates’ Court last week to careless driving, exceeding the legal blood alcohol limit within three hours of driving and possessing a controlled weapon without excuse.
The court heard that on November 27 Devlin was driving a black Holden ute on Roslyn Park Dr, Melton when he crashed into a tree on the nature strip.
A witness called emergency services about 10.30pm before police arrived and interviewed him.
The 37-year-old was breath tested which indicated he was above the limit.
His vehicle was towed and he accompanied police to the station where he alerted officers there was a knife in his pocket.
His reading was 0.138 — almost three times the limit.
In court, Devlin told Magistrate Peter Reardon he initially got the knife after he was the victim of a home invasion but he carried it on his person permanently now for “whatever might be going on”.
The court heard he was in a difficult financial position and relied on disability support payments due to a previous spinal injury.
Devlin said he made a “terrible mistake” driving that night and he was very remorseful.
He was convicted and fined $1000 and ordered to pay costs of $136.
His licence was cancelled and disqualified for 13 months, effective from the date of the crash.
