Jerry Basay pleads guilty in Werribee Court over assault of sister’s ex-boyfriend

A man who violently assaulted his sister’s ex-partner outside a western suburbs shopping centre told cops his victim was “being dramatic” after suffering multiple facial injuries.

A Werribee man told cops his sister’s ex-boyfriend was “being dramatic” after physically assaulting him outside a western suburbs shopping centre.

Jerry Basay pleaded guilty in the Werribee Magistrates’ Court on January 14 to assault over a 2019 incident, where he beat up his sister’s ex-boyfriend.

The court heard Basay had been 15 years old when his older sister had been dating the victim — a relationship Basay said “ended badly”.

Five years later – in June 2019 – Basay saw the victim at the Pacific Werribee Shopping Centre.

He waited for the victim to come outside of the centre before unleashing a barrage of 14 punches and one kick in the space of “10 to 15 seconds”.

The entire incident was caught on CCTV camera.

The court heard the attack left the victim with a gash to his nose, a swollen lip and other facial injuries.

After his arrest, Basay told cops he “was very angry with what (the victim) did” to his sister.

“I just wanted to pay back what he did to my sister,” he said.

“He was slut shaming her, broke her car and everything – now I’m grown I have this anger towards him because of what he has done.”

Basay denied “bashing” the victim, telling cops he “gave him two hits” and that the victim was “being dramatic”.

The court heard Basay had “just turned 20” at the time of the assault and had been suffering with mental health issues and anger management.

He had since seen a psychologist and admitted the incident was “an irrational choice”.

Magistrate Carolyn Howe said while she understood the incident was “in defence of his sister”, Basay had an “irrational and angry” reaction.

“You can’t respond with violence,” she said.

“You’re lucky – if he had hit his head and died you wouldn’t be in this situation today.”

Ms Howe sentenced Basay to a 12 month adjourned undertaking, requiring him to be of good behaviour and continue engaging with mental health services.
