Truckers in family affray over a parking spot leave victim in hospital with cuts to face, head

A verbal dispute over a Cranbourne parking spot turned nasty when a turban was pulled from a trucker’s head. One man was taken to hospital by ambulance with cuts to his mouth and the back of his head.

Two brothers and their cousin got involved in a rock-throwing ruckus over a truck parking space.

Dandenong Magistrates’ Court heard Lyndhurst trio Apvinder Sandhu, Rupvinder Singh and Jagmal Singh – and an unknown man – got involved in a heated scuffle with two other men at a Cranbourne parking yard.

One of the victims received cuts to his face and head, and abrasions to his arms in the attack, which escalated after one of the accused had his turban pulled off of his head.

Sandhu, 35, and Rupvinder Singh, 33, pleaded guilty to affray and recklessly causing injury yesterday.

Younger man Jagmal Singh, 25, pleaded guilty to one charge of affray.

The court heard the victim called one of the accused on the phone about 7pm on March 20 last year complaining that they had parked their truck in his spot.

About 10 minutes later Sandhu and the two Singhs, and another man, arrived in a ute and confronted the victim and his business partner.

A verbal disagreement began and Sandhu and the older Singh punched and slapped the victim and the younger Singh chased the partner around the yard.

The victim broke free before a fourth assailant threw a rock at his face, cutting his lip, and then a second stone as he lay on the ground.

The victim was taken to hospital by ambulance with cuts to his mouth and the back of his head.

When interviewed later Sandhu said the victim “had disrespected him” by pulling his turban off and the argument had gotten out of hand.

In court their defence lawyer said they had gone to the yard to discuss the parking issue but had not planned to fight.

He said there was “a bit of back and forth” between the parties, but when a turban was removed the fracas escalated out of control.

He said none of the trio had priors and they played a lesser role than the unknown rock thrower.

All were sorry and had done anger management courses to learn how better to control their emotions, he said.

“The injuries suffered were nasty, but I accept the unknown offender had the main role,” she said.

“But your behaviour also contributed to the fact he was injured. You’ve now acknowledged you could have done better by pulling back.”

All three were given non-conviction 12-month good behaviour bonds, with Sandhu and Rupvinder Singh ordered to pay $750 to the court fund, while Jagmal Singh has to pay $500 to the court’s coffers.
