A sadist son who punched his mum, pushed and racially abused his boarding house neighbour, assaulted hospital guards with a chair and scratched a police officer has been jailed.

But Toby Thirlway will be out in a matter of days after already serving most of his sentence on remand.

The Endeavour Hills 24-year-old pleaded guilty to assaults, criminal damage, trespass, harassment and court order breaches at the Dandenong Magistrates’ Court on Tuesday.

The court heard Thirlway was staying in a large boarding house in Endeavour Hills in January last year.

For no apparent reason he suddenly launched into a racist tirade at a neighbour who was sat nearby quietly drinking a cup of coffee.

He then pushed the victim in the chest, walked into their room and smashed up a TV and phone before nonchalantly walking out.

In February this year Thirlway attended the emergency department of Monash Medical Centre in Clayton with an elevated heart rate.

While waiting to be treated he became aggressive and when hospital guards arrived on scene he picked up a chair and swung it at them, hitting one on their arm and another in their face.

Police then arrived and as he was being held down he scratched the arm of one officer, causing a 20cm cut, before he was sedated by doctors.

In January this year Thirlway attended a Noble Park motel where his mother was staying.

He forced open her front door, knocked over her furniture, broke her TV and punched her in the face, causing her to fall into a garden bed.

Thirlway also threatened a former pal via phone and text messages, calling the man a paedophile and saying he would take down “the f***ing dog c***”.

He was meant to be doing a community corrections order at the time.

Defence lawyer Adam Maloney said Thirlway, who had a mild intellectual disability and a suite of mental health and behavioural issues, had a “difficult history” with his mother.

He said his client had NDIS support available and was hopeful of being able to return to the Endeavour Hills boarding house when released.

Magistrate Greg Connellan jailed Thirlway for a total of 220 days, with 201 days classed as time served.
