Tired criminal spends 16 days in prison after he was found illegally sleeping at mother’s Hallam house

He had been staying at a mate’s place but it was too noisy to sleep and he didn’t feel safe. So he went to his mum’s Hallam home for 40 winks, but his sweet dreams soon became a nightmare.

A sleepy crook who police found illegally at his mum’s house ended up getting the rest he needed – spending the next fortnight in a prison bed.

Milan Dukic was banned from attending his mother’s home but went there anyway because he couldn’t get any shut-eye while he was staying at his mate’s motel unit.

Police were called and he ran off, jumping over fences and into a neighbour’s yard before officers arrested him.

Dukic was on a community corrections order at the time that had been imposed just days before.

The 32-year-old pleaded guilty to two breach charges at Dandenong Magistrates’ Court on Tuesday.

The court heard Dukic had been told on July 15 this year not to go to his mum’s Hallam home or he faced the risk of being arrested.

But four days later on July 19 police were called after they received a report he was sleeping there.

When officers came Dukic had already got of bed and tried to make a run for it, but he was soon caught and remanded in custody.

His defence lawyer told the court he was “practically homeless” and had been staying in the spare room of a pal’s place but there were a lot of coming and going and he felt unsafe and tired, so went to his mother’s home for some peace and quiet.

He said Dukic, who had had issues with “party drugs and sporadic methamphetamine use” in the past, “had a (criminal) history that does him no credit”.

He said while he knew what he was doing was wrong, there was no violence involved in the offending and all he wanted was a safe place to sleep.

Magistrate Andrew Halse said he required an updated corrections order report and adjourned the case for an assessment.
