Two Berwick brothers have fronted court facing more than 100 hooning allegations where one twin allegedly reached 260km/h on the Monash Fwy, while filming themselves and seat swapping.
Sushant and Subhanu Mittal, 19, appeared in the Dandenong Magistrates’ Court on March 5, as Sushant faced a long list of hooning charges spanning across multiple major Melbourne roadways.
Appearing in separate court rooms, the brothers both had their matters delayed.
The court heard Sushant’s more than 100 charges across 12 briefs where police allege he sometimes drove at more than 260km/h while also filming himself driving.
The court heard Sushant was clocked doing 184km/h on the Monash Fwy on August 19 in 2022, just seven months after getting his probationary licence.
The passenger of the car filmed the incident, where it is alleged Sushant said “this is literally what I do as a game”.
The video was later allegedly uploaded to his TikTok account.
Police attended his Berwick address, where he allegedly admitted to being the driver.
His alleged behaviour escalated from this incident, as police alleged he engaged in speeding, hooning, drag racing and other dangerous acts including swapping seats with a passenger and leaving the car without a driver while it travelled fast.
Police allege Sushant drove at 217km/h in a drag race with another car on January 1 in 2023, in an 80km/h zone.
The peak of Sushant’s alleged offending was April 25 in 2023, when police say he reached 262km/h on the Monash Fwy in Hallam, while overtaking other road users.
The court heard on all occasions of Sushant’s alleged offending, there would have been “no time for other drivers to properly react, and would have certainly led to death or serious injury”.
Just two days later, Sushant is alleged to have filmed himself driving at 261km/h on the Monash Fwy, saving the video to Snapchat.
The court heard police had since seized the vehicle Sushant was alleged to be driving to have it tested.
Investigating officers found the car had been modified to enable it to reach the high speeds which Sushant has been alleged to have travelled at.
Sushant’s lawyer Younis Yehia asked the court for a sentencing indication, should his client decide to plead guilty.
Magistrate Fran Medina said she would hand down a combination sentence, including time behind bars, as the offending was “far too serious”.
“It’s a miracle that everyone is still alive,” she said.
“It’s a pattern of behaviour, a callous disregard to his own life and so many others.”
Ms Medina said it was aggravated by Sushant allegedly uploading the videos to social media to gain notoriety.
“This offending is appalling, he’s placed too many people’s lives at risk to avoid a non-custodial sentence,” she said.
Mr Yehia and his client declined to accept the sentencing indication, opting to proceed with a contest mention at a later date.
Another courtroom heard Subhanu Mittal’s lawyer Omar Chmeisse ask Magistrate Michael McNamara for a further adjournment due ongoing conferencing between his firm and Victoria Police.
“We are still waiting on body worn camera footage,” he said.
“The second matter is also still in the process of being case conferenced.”
Sushant will return to court for contest mention on April 30, while his brother, Subhanu, will return to court on April 15 for further mention.
