The case of Timothy Bryant, 35, was called in the Melbourne Magistrates’ Court on Tuesday for a filing hearing while he’s yet to enter a plea.
Mr Bryant is facing one charge of possessing child abuse material.
He appeared in the Frankston Magistrates’ Court last week for a plea but police made a last minute submission that the matter should be heard in the County Court.
Mr Bryant is accused of being found with “tens of thousands” of category one and two child abuse images.
Police found the alleged material after executing a warrant and searching his phone and computer.
Mr Darcy for Mr Bryant fought the submission from police and said the matter could be sufficiently dealt with in the magistrates court as it was a first offence and there was psychological evidence to support it staying.
Magistrate Michael Wighton adjourned the case until January 12, 2024 for a mention hearing.
