Staff at Dandenong Hospital were forced to give up treating an out-of-control man after he threatened to “kill” and “torture” them.
Daniel Davis, 30, pleaded guilty in the County Court this week to a swag of charges and was remanded for a plea hearing in December.
Judge Nola Karapanagiotidis has ordered a number of reports after it emerged Davis, unemployed and without a place to stay, had an intellectual disability.
He pleaded guilty to charges of threatening to assault and kill emergency workers, resisting arrest, theft, intentionally causing injury, common assault and possession of cannabis.
Prosecutor Jessica Van-Dyk told the court Davis was on bail when he committed the latest offences on February 9 this year.
She told the court CCTV showed Davis walking around Dandenong in Sunnies before going to Hungry Jacks on February 9.
He approached a man ordering his food and asked him for $20 but the diner asked him to wait until he had finished his meal.
Davis said he didn’t want to wait and began to pace back and forth while pointing at him.
Armed with a metal rod, he gesticulated wildly and pushed his body forward as if he wanted to fight the man who told him to move away.
Davis then put the weapon away and extended his hand and both men held hands as if to shake but Davis pulled his hand back and started ranting. A Hungry Jack’s employee asked them to leave.
Grabbing the rod, Davis threatened the worker before hitting the diner on the head and stealing his food.
The man suffered a gash on his temple but decided not to go to the hospital.
Police found Davis 10 hours later outside Hungry Jack’s, twitching repeatedly.
He began to run away from police and it took six cops to hold him down.
Officers found toothpaste in his undies that he stole from a 7/11 store, and cannabis in his backpack.
At the Dandenong Hospital, Davis was handcuffed to a hospital bed while being treated but his behaviour escalated to the point police were forced to turn on body cameras.
He shook the bed at times to free the handcuffs and looked fiercely and intently at people.
“I love to f***** torture you c****. I will remember your faces till the day I die,” he said to medical staff.
Davis continued: “I’ll kill you and slice you from one side to the other. I’ll kill them and kill myself. I’ll remember his and her face, I tell ya. Hurry the f*** up.”
Ms Van-Dyk said Davis racially abused a security guard.
“I’ll bite your f***** nose off. You’re in my f***** country. I am an Aussie. You from South Sudan, f*** off. I’ve done boxing c***.”
No victim impact statement will be filed in court.
Ms Van-Dyk said Davis suffered from a range of medical conditions and illnesses.
The case has been adjourned until December 15.
