Mornington Peninsula real estate agent nabbed drink driving after hammering down wines at long lunch

A prominent real estate agency boss has had to endure a negative hearing in court after his car was clocked travelling at 106km/h in a 80km/h zone following a long liquid midday lunch with mates at a Red Hill vineyard.

A Peninsula real estate agency boss was well above reserve when he was nabbed drink-driving after a long liquid lunch.

Kayn Luff, a director at OBrien Real Estate, pleaded guilty to drink-driving and speeding at Dromana Magistrates’ Court yesterday.

The court heard Somerville Highway Patrol police clocked the 34-year-old numbers man’s car travelling at 106km/h in a 80km/h zone while he was driving home from a midday booze-up with mates at a Red Hill winery about 7.25pm on March 10.

Luff badly misjudged his level of intoxication after hammering down “five or six wines over a five or six-hour lunch” as he recorded a blood alcohol reading of .106 at Mornington police station about 8pm, losing his licence on the spot.

He was uncooperative with officers, saying he didn’t know he was speeding and didn’t answer questions regarding his alcohol level.

In court, Luff’s defence lawyer said his client, who is expecting a child in December, had been having lunch “over an extended period of time” with friends at the winery.

The lawyer said Luff had consumed five or six glasses of wine over a five to six hour lunch, believed he was okay to drive, but “got it wrong, quite frankly”.

He said the speeding was due to overtaking a slower car on a hill and the drink-driving charge had a “sobering effect, no pun intended” on Luff, who has no priors for any crimes.

Luff’s online mission statement says he has been involved in the real estate industry for 16 years and he “was always looking for ways to improve”.

His spiel also says “everyday throws up something different, something to ensure we go that extra mile and succeed”.

Magistrate Gerard Lethbridge said Luff’s miscalculation was a costly one.

“I am pleased to hear he is no longer drinking,” Mr Lethbridge said.

“Rather than to rely on stupid calculations, the simple rule is not get behind the wheel if drinking any alcohol whatsoever.”

Luff was convicted, fined a total of $1100 and had his driving licence disqualified for 10 months, backdated to the date of the offence.
