A Dandenong man who violently assaulted a rehab clinic worker and threatened a teenager for his phone has blamed his offending on a substance abuse problem.
Mohammed Mamudov, 23, pleaded guilty in Dandenong Magistrates’ Court on July 22 to assault, drink-driving and theft charges.
The court heard Mamudov first came to the attention of police on October 2022, when he was driving on Elliot Rd in Dandenong South and collided with a van and then a metal fence.
Mamudov continued driving, eventually going through a red light on the Dandenong Bypass, colliding with another car.
The smash caused the victim to spin 180 degrees and Mamudov’s car to roll, trapping him upside down in the vehicle.
He was taken to The Alfred for treatment for his injuries.
Later Mamudov told police he “didn’t remember what happened”.
“I just woke up in hospital with a neck brace and very agitated,” he said.
The court heard a blood test following the accident showed he had a 0.143 blood alcohol level reading, while being a probationary licenced driver.
Probationary drivers are required to have a 0.00 blood alcohol reading.
Mamudov caught the eye of police again in March 2023 when he stole a bike from the Lynbrook railway station, all captured on CCTV.
He levelled up from petty theft to harassment in January this year when he followed a 16-year-old, hassling him for spare change.
The court heard Mamudov followed the teenager from Lynbrook station by train to Dandenong station, where he further accosted him for money and his phone.
The victim again refused and got onto a bus, after which Mamudov stood in front of the bus, yelling at the victim “I’ll follow you everywhere, I’ll f--k you up”.
He was later arrested and gave a no comment interview.
The court heard the final straw for Mamudov was during a stint in a Geelong rehab clinic in March.
After a day out to get ice cream, Mamudov turned on one of the clinic staff in a violent tirade of verbal and physical assaults.
He threw a glass tumbler at the staff member, which smashed over the victim’s head, before flipping a coffee table and attempting to assault the victim further.
The victim retreated into an office, shielding himself behind a table, as Mamudov hurled verbal abuse at him, saying “You’re a mutt, I know people, I’m going to kill you”.
The court heard he punched holes into the walls of the clinic before police attended and arrested him.
In court on Monday, Mamudov’s lawyer Theo Magazis said his client had been experiencing psychosis, depression and anxiety while he was seeking help for his substance abuse issues.
“He used drugs for a significant period of time, and tried rehab in 2021, before going again earlier this year,” Mr Magazis said.
“He’s clean now and has a supportive family.”
Magistrate Julian Ayres sentenced Mamudov to an 18-month community corrections order with conviction.
He was ordered to pay the victim of the bike theft $295.99 in compensation and a $1000 aggregate fine.
