A police sergeant accused of dragging another police officer for 10m and later resisting arrest has been released back into the community.

Mornington man Hayden Bodycomb, 47, appeared in Melbourne Magistrates’ Court on October 9 from police custody.

The court heard Mr Bodycomb had been pulled over by police on October 4, where he spoke to officers before allegedly holding onto the arm of one as he drove away.

Police allege Mr Bodycomb dragged the officer for 10m before releasing him.

Mr Bodycomb was taken into custody on a later date after he attended Mornington Police Station for an appointment.

The court heard he allegedly resisted arrest and was later capsicum sprayed and taken to the Frankston Hospital for psychiatric assessment.

In court on Monday, Mr Bodycomb’s psychologist Anne-Marie Hyde gave evidence that his mental health had significantly deteriorated in custody.

“He needs appropriate mental health support, whether that is with hospital intervention or not,” she said.

Ms Hyde said Mr Bodycomb only presented a risk to himself, not to the public or to other members of the police force.

Magistrate Charlie Rozencwajg released Mr Bodycomb on bail ahead of a contest mention set to be held next year.

“I’m satisfied that compelling reasons exist with Ms Hyde’s evidence of his deterioration in custody,” he said.

“I wouldn’t think in the circumstances of this case there is an unacceptable risk (to the public).”

Mr Bodycomb was released from custody on bail and will return to court on January 8, 2024.
