Man who punched man unconscious at Frankston pub gets jail term slashed on appeal

A boozed-up brute who knocked a man out cold for three minutes in a one-punch attack at a Frankston pub will walk free within days after having his jail term cut, despite the judge saying the thug could have killed his victim.

A one-punch thug who decked a dancer at a Frankston pub, leaving him lying unconscious on the ground, has had his jail sentence slashed on appeal.

Drunk brute Tyler Black, who had been boozing all day with his footy final-losing brother before the attack at The Deck, faced the County Court yesterday morning after appealing a five-month prison sentence handed down earlier this month.

The court heard Black entered the Davey St pub with his brother and two female friends about 12.40am on September 9 last year.

The trio drank and enjoyed themselves until Black’s brother “shouldered” a man dancing nearby about 2.20am.

There was a confrontation before security stepped in. Black broke free and “launched” into the air, smashing his hapless victim to the face with his right first.

The man fell unconscious to the ground and was out cold for three minutes while bouncers dragged Black and his brother from the premises.

The victim received bruising and abrasions to his face, had to have an MRI, needed time off work to recover and still suffered memory loss and headaches, the court heard.

When police arrested Black he said his memory of the incident was “a little hazy”. But, after watching CCTV of the bashing, Black said he “felt sick”.

He told officers he had been drinking heavily and intervened when he saw his brother with the victim but knew he should have walked away.

His defence lawyer said Black, who had no priors, had since completed anger and alcohol courses, was extremely remorseful and had excellent prospects of rehabilitation.

His brother, who didn’t punch the victim, received a no-conviction fine for his involvement in the altercation.

Judge Trevor Wraight said it was “just luck” that Black hadn’t killed the man and be facing a manslaughter charge.

“He charges at him with his right fist … (the blow) is of such force he went down and was unconscious,” Judge Wraight said.

“(But) in stark contrast to his behaviour this evening he has no priors, seems he has a relatively stable upbringing, is hard working, made full admissions, and is accepting of what he did was wrong.”

He reduced Black’s five-month jail term — for recklessly cause injury and affray — to just one month.

The 24-year-old Frankston carpenter has already served 26 days in custody and will walk free next week.

Upon release Black must do an 18-month community corrections order and 100 hours of unpaid work.

He must also undergo alcohol and offending behaviour programs and is banned from all licensed premises for a year.

Black is not the only one-punch coward to make news this month.

On May 21 a thug who unleashed a sickening, unprovoked attack on a stranger on a Frankston street finally admitted to the coward’s punch.

And a court order banning Ryan Wells, 33, from being publicly named as the attacker was lifted.

CCTV cameras captured Wells lunging at his unsuspecting victim, felling him with an elbow to the head in July last year. Wells will be sentenced over the Frankston attack next month.
