A Noble Park creep who performed lewd acts in front of terrified children and their families has walked from jail.

Luis Da Cunha, 64, pleaded guilty to sexual offences relating to a string of disturbing incidents at the Parkfield Reserve playground in December last year.

Da Cunha’s offending included performing a lewd act in front of a couple and their two children aged two and 18 months about 5.45pm on December 3, and removing his genitalia from his pants in front of a mother and her three daughters aged two, four and six about 10.45am on December 5.

The court heard Da Cunha also touched a woman’s breast outside a Noble Park shop on November 11, 2019, telling her that he wanted to sleep with her.

Magistrate Suzette Dootjes said she had “no doubt” Da Cunha’s victims had been left “distressed and frightened”.

“Women in the street and families in the playground are entitled to go about their activities without being violated with this kind of behaviour,” she said.

Da Cunha’s lawyer argued his client, who does not speak English and required a Portuguese translator, suffered from paranoid and delusional thinking and had been diagnosed with schizoaffective disorder.

Ms Dootjes noted Da Cunha’s offending appeared to occur in the context of when he had trouble with his medication.

She said Da Cunha required a dedicated health team to help treat his medical condition and that a GP was not sufficient to keep him “well”.

“(A community corrections order) will ensure continual case management with the appropriate mental health services and outreach workers (who) will contribute to management of you when you’re released in the community,” Ms Dootjes told Da Cunha.

Da Cunha was sentenced to 83 days behind bars reckoned as time served and was ordered to complete a two year community corrections order upon his release.

He was made a registered sex offender for life.
