Kia Judge: Banned driver caught behind the wheel five times

Despite having no licence, a misbehaving Cranbourne mum thought it was okay to drive to go and look through hard rubbish and pick up a PlayStation.

A menace motorist was pulled over for driving while banned five times – including twice in one day, a court has heard.

Kia Eloise Judge had been ordered off the road after she had failed to complete a drug and drink drive program for a previous road rule violation.

But that didn’t stop the Cranbourne 35-year-old mother of three from jumping in her car on five separate occasions.

Judge pleaded guilty to a series of traffic crimes at the Frankston Magistrates’ Court on Wednesday.

The court heard just after midnight on February 14 last year a routine police patrol pulled up Judge’s Holden Commodore in Cranbourne.

She told officers she was unaware she was a banned driver as she had not received any correspondence about it.

But at around noon the same day she was caught again, this time in Narre Warren, even though cops had implicitly told her just that morning she was not permitted to drive.

Then in March she was pulled over in Frankston, and she was nabbed twice in September, once in Langwarrin and the second time in Frankston.

Her excuses included picking up a games console for her son, going to rummage through hard rubbish in the dead of night and dropping off her boy at his father’s house.

Her licence had been cancelled in 2019 because she had not done a drug drive course after she was caught high behind the wheel in 2018.

Defence lawyer James Dowsley said Judge conceded she “had been put on notice” by police after the first intercept but continued to drive regardless.

He said in the past the single mum pensioner hadn’t had the funds to do the required course, but she was endeavouring to do it as soon as possible.

Magistrate Timothy Gattuso said looking through hard rubbish in the middle of the night and picking up a PlayStation hardly classed as emergency situations where she no choice but to drive.

“She was fully aware (she was banned) as she had been told by police on the first occasion,” Mr Gattuso said.

“Yet she repeats it, including on another occasion the same morning.

“When authorities make an order against her licence, she has to abide by it.”

He told her not to drive while disqualified again.

“You can’t just take it upon yourself to drive, you don’t have a licence,” he said.

“You’ll end up in custody, your kids will have to come and see you in custody.”

Judge was convicted and placed on a 10-month community corrections order with 100 hours of unpaid work.

She was also banned from applying for a licence for nine months.
