An elderly man who sliced open his neighbours hand with a shovel has told a court he had been bullied for years.
Peter Flemming, from Frankston, appeared in the Frankston Magistrates Court on Monday where he originally contested charges relating to assaulting his neighbour and a minor arson.
Flemming eventually pleaded guilty to the charges after receiving a sentence indication.
The court heard on March 17 this year Flemming and the victim were arguing about Flemming making too much noise.
Later in the day Flemming was in the shared laundry when the victim came in and they began arguing again.
The court heard Flemming then went and grabbed a shovel and began swinging it at the victim.
The victim raised his hand to protect himself and sustained a large, deep cut to his hand which later required plastic surgery.
Allegedly the victim also had some sort of weapon and was hitting Flemming on the legs with it.
Flemming claimed the victim’s cut came from him hitting a door and not from the shovel.
Flemming was also facing a charge of arson after he set personal papers alight in a bin belonging to Georgie Boys Pizza in Seaford.
He told police he needed to destroy the papers to protect his privacy but hadn’t meant for the entire bin to catch fire.
Magistrate Charles Tan gave Flemming a $1800 fine for the assault and placed him on an adjourned undertaking in relation to the arson.
