Dale Byrne: Father of three sent threatening emails to Cardinia City Council over $10,000 parking fines

A man who received parking fines of up to $10,000 sent the Cardinia City Council emails, threatening to “break their legs” if another person touched his truck.

A man, who sent the Cardinia City Council emails threatening to “break their legs” if they gave him another parking fine, was placed on a good behaviour bond for twelve months.

Dale Byrne was sentenced after pleading guilty to using a carriage service to menace in the Dandenong Magistrates’ Court on Tuesday, June 20.

The court heard Byrne parked his truck in a residential street outside his house when money was tight during Covid and received multiple fines, up to $10,000, for leaving the vehicle parked on the street for over an hour.

He then sent emails to council telling them to not touch his truck saying he was getting “sick of this bulls--t” and the parking inspector “needs a smack in the face”, before signing the email “sincerely, go f--k yourself”.

In a police interview Byrne said he had no intention of paying the fines and he wanted them to stop issuing parking tickets.

Magistrate Kilias slammed the man saying if he didn’t pay the fines one day “police will rock up, climb all over your truck and lock it up”.

“They will have legal means to take your property if you don’t pay the amount, that’s how it works,” he said.

He also said “no amount of bravado threats will stop them”.

“You mustn’t allow your frustration to boil over and take it out on people who are just trying to do their job, just as you are trying to do your job,” Mr Kilias said.

The magistrate placed the father of three on a good behaviour bond under the condition he writes a letter of apology to the CEO of the Cardinia council.

“A financial penalty will be taking out of your children's mouths, so I will place you on good behaviour for twelve months,” Mr Kilias said.
