A convicted child porn downloader who failed to tell sex offender cops he was living with a woman and her young son has escaped a jail sentence.
Kris Allan Drummond has been warned if he breaches the register again he will definitely be going inside.
The 33-year-old Rosebud part-time building contractor pleaded guilty to sex offender register breaches at Frankston Magistrates’ Court yesterday.
Drummond was sentenced in 2015 by the County Court for one charge of using a carriage service to access child pornography.
That related to an extremely serious example of child pornography found on Drummond’s computer involving a girl aged between three and five being filmed while being abused.
In her findings Judge Meryl Sexton said the 49-minute movie, consisting of 14 scenes of the one girl, was “depraved”, and “shocking”.

The court heard Drummond was drunk when he went online looking for “teenage girls”.
He stumbled across the United States’ video of the girl, but his computer’s IP address was picked up by police and his home was raided.
He was jailed for 12 months but immediately released on a two-year Commonwealth supervision bond, including conditions he do a sex offender program if required and pay a $1000 security.
He was also placed on the sex-offender’s register for eight years.
Part of that order was that he must tell police all of his personal details, email and contact numbers and where he was living.
On November 12 last year he rang the registry number and left a message saying he was planning on moving house, but when officers went to his Ferntree Gully house a few days later, Drummond had already gone.
Police then interviewed him and he said he had already moved in with his girlfriend and her young son in Rosebud, which was a violation of his conditions.
His defence lawyer said his details had now been updated on police files, the DHHS were involved with a safety plan, and a psychologist’s report stated he didn’t pose a risk to the community.

But Magistrate Gerard Lethbridge said it was not up to him to decide if he was a risk or not.
“This was deliberate; you actually provided false information, this is something the police, DHHS and the community feel very concerned about,” Mr Lethbridge said.
“You were at the County Court involving child pornography, and here you are living with an eight-year-old.
“The register is there to make sure offenders don’t live with children without checks.”
Drummond was convicted, and placed on a 12-month community corrections order involving 150 hours of unpaid work.
