Cannabis addict caught by police dealing dope twice in six months says the drug was for personal use and he only sold to friends

A cannabis addict twice nabbed by police with bags of pot in his Rosebud home denied he was a marijuana merchant, saying the “chuff” was mainly for personal use.

The cannabis addict was twice nabbed by police with scores of bags of pot in his Rosebud home, but denied he was a marijuana merchant, saying the “chuff” was mainly for his own use.

David Burton pleaded guilty to four charges at Dromana Magistrates’ Court yesterday.

The court heard police searched the 43-year-old’s Rosebud house on August 10 last year, finding dope all over the place.

They came across 105 foils of cannabis in a plastic container, another 17 foils scattered around the house and a shopping bag full of the drug.

They also found digital scales and two smaller bags with more marijuana inside and when they searched him, they located three more foils and $215 in cash, presumed to be proceeds of crime.

He told officers it was “mostly for personal use”, but he also did “sell some to friends”, and was arrested and bailed.

In a second incident on January 15 this year police came to his shared house looking for someone else and saw Burton secrete a bag of something under his chair.

It was 43g of cannabis; he said it “was just a bag of chuff, he wasn’t selling it” and he was again arrested and bailed.

His rap sheet shows he has form for growing the green, with cultivating and trafficking drugs priors in his criminal past.

In court his lawyer said Burton, a disability support pensioner, had an addiction to cannabis dating back decades.

She said he had an acquired brain injury from a fall when he was aged seven, and started using the drug to cope with anger management issues in his teens.

She said he was now seeking medical help for his addiction, and was “making efforts to cut down his marijuana use”, but he had a long journey ahead of him.

She said jail was not the place for him and a community order would be beneficial.

His case was adjourned for a community corrections order assessment.
