AN ALLEGED car thief and his mates allegedly torched a hot Holden because it broke down at a servo, a court has heard.
The Commodore, stolen from a Seaford house the day before, was set alight next to a Burwood petrol station.
DEADLY DOZEN FILES THROUGH COURT
Brandon Braithwaite, 22, faced court on a range of charges at Frankston Magistrates’ Court on September 17.
The court heard a Seaford house was broken into about 3am on March 11 last year while the occupants slept, with two sets of car keys taken.
The thieves failed in their bid to steal a Mitsubishi before taking in a Holden sedan.
The day after at about 1pm Mr Braithwaite was allegedly a passenger in the Holden when it pulled up at the BP servo in Burwood.
After a few minutes it was seen on CCTV being pushed into a nearby street as Mr Braithwaite went into the store.
He took a mobile call and then allegedly got a jerry can and filled it with petrol before walking to the car.
It was then set alight, causing a “significant explosion” and several people were seen running away.
Mr Braithwaite was later arrested on other charges and remanded.
In court his lawyer asked for a sentence indication if he pleaded guilty to the charges.
She said he was in custody and wouldn’t be eligible for release until at least May next year.
Magistrate Dominic Lennon said Mr Braithwaite had a terrible history for someone so young and he indicated he would sentence him to 18 months in jail, with a minimum of 12 months.
His lawyer said he wouldn’t accept that and the case was adjourned until November 1.
