Simon Mattiske, Mt Evelyn building surveyor and inspector, banned by Victorian Building Authority

This Mt Evelyn building surveyor and inspector has been banned for allegedly carrying out illegal work across Melbourne’s east and the Bass Coast. But authorities aren’t finished with him yet and want to hear from anyone who has had dealings with him.

Property owners who have had work carried out by a Mt Evelyn building surveyor are urged to immediately contact the State’s top building authority.

The advice was issued following a Supreme Court injunction prohibiting Simon Mattiske from working as a building surveyor or inspector for three years, on Thursday, October 1.

Mr Mattiske had previously had his building surveyor and inspectors licences banned in February, but the VBA is alleging he has since illegally carried out work at 28 properties in Yarra Ranges, Maroondah, Boroondara, Monash and Bass Coast areas.

Mr Mattiske’s company – Simon Mattiske Building Surveyors Building Inspectors Pty Ltd – was placed into liquidation in January, and officially wound up in July.

The VBA have since suspended Mr Mattiske’s registration as a building surveyor and inspector, effective until 2023.

VBA chief executive Sue Eddy said while it was already a criminal offence for Mr Mattiske to work as a building surveyor and inspector while suspended, the injunction added a powerful deterrent.

She said the VBA sought the injunction to protect the public from further illegal work, given Mr Mattiske’s prior history of breaching the suspension.

Ms Eddy said Mr Mattiske’s refusal to comply with his previous suspension left the regulator with no choice but to take the matter to the Supreme Court.

She said if Mr Mattiske breached the injunction, the VBA could bring contempt of court proceedings.

“Public safety is our number one priority – Mr Mattiske has continually shown a complete disregard for the law, his clients and the industry as a whole,” Ms Eddy said.

“Mr Mattiske’s refusal to comply with the terms of his suspension not only placed undue stress on his clients, but it also brought the wider industry into disrepute.

“Nobody has the right to pick and choose which laws they follow.

“As the industry regulator, we make no apologies for pursuing him through the courts to keep people safe.”

The VBA is currently reviewing the validity of any certificates of final inspection, occupancy permits or building permits issued by Mr Mattiske since February 13.

Anyone who has had dealings with Mr Mattiske since his registration was suspended in should contact the VBA at customerservice@vba.vic.gov.au to discuss their circumstances.

The VBA’s investigations into Mr Mattiske’s conduct are continuing and may result in further enforcement action.
