A low-life grub who molested a teenage girl in her bed after a five-bottle whiskey bender claims he was under stress because he impregnated his mistress.

Casey Ferrer pleaded guilty in Broadmeadows Magistrates’ Court on Wednesday to sexually assaulting a child under sixteen,

In 2021, Ferrer — father of two from Roxburgh Park — crept into the teen’s bed at 3am and sexually assaulted her.

The court heard the girl woke up to the then 34-year-old’s hands under her shirt and was “shocked”.

The girl later told her mother, and Ferrer texted the girl’s father, saying he was “very ashamed” and that he did not know “why he did such a thing”, claiming he had no memory of the assault.

On Wednesday, Ferrer’s lawyer said her client was under “extreme alcohol intoxication” to the point where he could not recall the assault.

“He has estimated (to have drunk) five to six bottles of whiskey between five to six people,” she said.

“It was opportunistic and spontaneous (offending) and occurred under the influence of extreme alcohol intoxication.”

Ferrer’s lawyer told the court the now 38-year-old was going through “life stresses” when he assaulted the girl.

“He had a relationship breakdown with his ex-wife due to an extramarital pregnancy with his current wife, and as a result, his partner visa status was up in the air,” she said.

“(Ferrer) was expecting the child two weeks after this offending occurred.”

The lawyer also said it was “plausible” Ferrer was “experiencing adjustment disorder”.

“(After) he immediately contacted the victim’s family and apologised even though he couldn’t recall the incident.

“He’s horrified and shameful at what occurred on this day.”

Wearing a blue shirt, Ferrer sat in the court with his hands folded, supported by his wife and mother.

The lawyer also asked the court to consider a non-conviction as it would interfere with Ferrer’s visa application process as he was on a bridging visa.

“He has stable employment, an incredibly supportive family, social friendship group,” she said.

”A community corrections order may expose him to engage in certain groups with certain offenders and may prohibit him from continuing to work.”

What happens after a sexual assault?

Magistrate James Henderson said the sexual assault was “opportunistic” and for a short duration but said it would have been “quite confronting and upsetting to the teen.

“Sexual offending against children is a serious offence. (And leaves the victim) With all manner of ongoing mental health issues,” he said.

“I don’t have a victim impact statement, but you can certainly know that it would be quite confronting to be sexually assaulted in her own bed and her own home by someone she would (have) trusted.”

Ferrer was sentenced to pay a $5600 fine — without a conviction recorded — and placed on the sex offenders registry for eight years.
