A man who was caught driving without a licence has told a court his friend needed to get home — and he was also unlicensed, as well as drunk.

Jake Chau, 27, pleaded guilty to driving while disqualified at Heidelberg Magistrates’ Court on Thursday, February 27.

The court heard the concreter was caught driving a Hyundai sedan on Hughes Rd, Reservoir about 9pm on July 27, 2019, despite his licence being cancelled.

Chau’s licence was disqualified for 12 months after he was caught drink driving in 2018, the court heard.

Magistrate Marita Altman said while Chau getting behind the wheel instead of his intoxicated may have seemed like “the lesser of two evils”, it was no excuse for the offence.

“There’s never a good reason,” she said.

Ms Altman ordered him to pay a $500 fine as well as court costs, but spared him a conviction.
