Kylie Allely: Stepmum who killed Amber Allen sentenced for fatal Yallourn crash

A stepmum who was coming down from smoking ice when she fell asleep and killed a seven-year-old in a crash at Yallourn has been sentenced in court.

A young mum who was coming down from smoking ice and fell asleep behind the wheel in broad daylight, killing her stepdaughter in a horrific crash at Yallourn, has been jailed for three years.

Kylie Allely, 32, was sentenced in County Court on Monday over the fatal accident which killed her 7-year-old step-daughter and seriously injured others in October 2018.

The court previously heard the collision occurred on a road that posed “no difficulty” to negotiate, with straight stretches and “gentle” curves.

Allely had traces of methamphetamine in her blood, was repeatedly dozing off behind the wheel in the lead-up to crash, and had returned a positive result to a roadside drug test just weeks earlier.

Witnesses who saw Allely’s green Holden on the day of the collision said the vehicle veered erratically and escaped four near collisions in the moments leading up to the fatal accident.

At a previous hearing Allely’s barrister, Rishi Nathwani, said no jail sentence would punish his client as much as the guilt of having killed her stepdaughter and seriously injured other children.

In a letter, Allely wrote: “to members of the family, including my side, truly I am sorry”.

In a victim impact statement, Amber’s grandmother, Elizabeth Allen, said: “a parent should never outlive their child, let alone a grandparent outliving their grandchild.”

Ms Allen said she was still haunted by the thought of Amber having died surrounded by strangers at hospital.

“It is like my world has fallen to pieces. How can I carry on living life? It’s like I’m frozen in time, watching a movie I don’t want to be a part of,” she said.

The driver of the oncoming car said she still vividly remembers the sound of crunching metal as her car crumpled, trapping her until she was cut free with the jaws of life.

Her son had to have spinal surgery after the crash, and she said she feared for the worst when he told her, while trapped in the wreckage, that he could not feel his legs.

In sentencing Allely on Monday, judge Bill Stuart said she “continued on” despite the perforated line markings which alerted her she was crossing over into the wrong side of the road.

“The distance you drove while so fatigued was 3.5km,” he said.

“You imperilled other road users travelling towards you and you also imperilled the three children in your vehicle.”

The judge said he considered her remorse when sentencing Allely. He said her rehabilitation prospects were “excellent”.

Allely served 34 days in custody at the time of sentencing.

Her licence was also disqualified for four years. She will be eligible for parole in 22 months.
