An Epping restaurateur has had to front court after repeatedly being caught driving unlicensed and speeding, including in his business’ food truck.
Chef Ismail Tosun pleaded guilty to two charges of driving while disqualified, driving an unregistered vehicle and speeding before Heidelberg Magistrates’ Court on Thursday, September 3.
The court heard he was driving an unregistered minibus, which had been converted into a takeaway food truck, on Cooper St, Epping late on February 7 when he was found to be on a disqualified licence.
Tosun also ignored the fact his licence was still disqualified on May 3, when he was caught speeding in a Mercedes Benz on Edgars Rd, Epping about 10.37am.
The court heard he was clocked doing 83km/h in the 70km/h zone on the way to his Coolaroo restaurant Miksa.
Lawyer Greer Boe told the court the father of three had grappled with a series of “chaotic” incidents in the past five years and was getting his life back on track.
She said Tosun, who formally ran a successful restaurant in Collingwood, had started a Turkish food truck business in 2018, which he had recently relocated to a takeaway shop in Coolaroo due to Melbourne’s COVID-19 restrictions on businesses.
Ms Boe said Tosun hadn’t driven since he was caught in May and was voluntarily undertaking a road trauma awareness program.
Magistrate Stephen Ballek said Tosun must have had “a pretty bad” driving history to clock up a 10-month licence suspension, but was pleased he hadn’t driven since his latest arrest.
Mr Ballek fined him $850, plus $127.40 in court costs, and suspended his licence for a further month.
