An enraged man allegedly threatened to kill a stranger and his family before shattering his tooth in the middle of traffic in Mill Park.

A man allegedly threatened to kill another driver and his family before breaking the man’s tooth in a vicious Mill Park road rage attack.

Christopher Wagstaff, 36, fronted Heidelberg Magistrates’ Court on December 11, facing charges including recklessly causing injury and making threats to kill.

The Epping man allegedly assaulted and threatened another driver in the middle of traffic after damaging the driver’s car amid a fit of rage just after 6pm on August 16, 2016.

The pair allegedly became involved in a spat after Wagstaff overtook the man’s car via the bike lane in Epping and the man tooted at Wagstaff.

Wagstaff allegedly then got out of his car at a red light and asked what the man’s problem was.

The driver allegedly told Wagstaff he was “driving like a f*cking moron” before Wagstaff raised his fist and the driver told him to get back in his car, saying he’d proven his point.

Wagstaff allegedly then drove very slowly in front of the other driver, who tooted his horn, before Wagstaff pulled over and got out of his car again, saying, “Pull over, you’re f*cked”.

As the driver drove away Wagstaff allegedly hit his car’s side mirror, shattering the glass.

Wagstaff allegedly then followed the driver and cut off several drivers to pull up in front of him on Civic Drive, Mill Park.

He allegedly ran up to the man’s car and said, “Do you want to fight?” before the man said ‘no’ and told him the police were on their way.

Wagstaff allegedly said, “If you call the cops on me, I’m gonna come to your work then I’ll follow you home and kill you and your family”.

When the man allegedly said it was too late and backed off, Wagstaff allegedly punched him in the jaw three times as the man told Wagstaff to let him go.

The man then walked back to his car before Wagstaff allegedly punched him in the jaw again, splitting his lip and breaking his tooth, and said, “tell the cops and you’re f*cking dead”.

After Wagstaff was arrested over the incident in 2018 he allegedly told police he’d hit the man and busted his tooth as “self-defence”.

The court heard Wagstaff still maintained the incident was self defence and would be contesting the charges.

His matter will return to court on October 6, 2021.
