Sunshine Magistrates’ Court: Gisma Khamis Lieba, 23, loses licence after drink driving, assault

A former Melton catholic school student told a court she had given up the drink after she assaulted the owner of a parked car she rammed while intoxicated.

A former Melton catholic school student told a court she had given up the drink after she assaulted the owner of a parked car she rammed while intoxicated.

Melton woman, Gisma Khamis Lieba pleaded guilty in Sunshine Magistrates’ Court to multiple charges related to drink driving, careless driving, two counts of assault, failing to exchange details after a crash and breaching bail.

On November 1, 2022 Lieba was driving along Wilson Rd, Melton South before she crashed into a parked car on Albert Dr.

The court heard she was driving carelessly and was incapable of controlling the vehicle due to her intoxication.

The owner of the vehicle came outside to inspect the damage and asked the woman, who was 22 at the time, for ID before he was confronted by a male passenger.

Police prosecutor Aaron Taylor said an argument erupted between the parties before Lieba smacked and punched hit the victim.

Mr Taylor said she was “aggressive” and assaulted a second person before police arrested her.

Lieba was sent Sunshine Hospital under police supervision where she recorded a blood-alcohol level of 0.248.

Not only was she on a probationary licence, she was under strict bail conditions to not be intoxicated.

Magistrate Michael McNamara was then told about an incident the previous year at Werribee where the woman was involved in another car accident.

During that incident on Christmas Day, a vehicle collided with Lieba on Werribee St and Lieba refused to exchange details before she fled the scene.

The victim told police her two children in the back seat were frightened when Lieba became aggressive before she pleaded with them not to contact police.

Lieba’s lawyer, Ms Catharina said her client was a young person who made poor decisions due to negative peer influence and alcohol abuse but claimed she could barely recall the Melton incident.

Ms Catharina said her client arrived in Australia as a child from South Sudan, went to school at St Francis Catholic College, formerly Catholic Regional College Melton, and had work experience at McDonald’s, warehousing, and a brief stint at the ATO.

She said Lieba had stopped drinking since the incident and worked hard to be a better role model to her five younger siblings.

She had no priors, and was supported by her parents in court.

Mr McNamara placed her on a 12 month CCO and ordered she do 80 hours of community work.

Her licence was suspended for two years.
