Hasan Gunes, linked to bikies, allegedly fired shots after nightclub fight may be allowed to leave country to visit father

A man with links to a bikie gang might be granted permission to leave the country to say farewell to his dying father in Turkey despite being arrested for an alleged shooting.

A man with links to bikie gangs has applied for bail in order to return to Turkey so he can farewell his dying father.

Hasan Gunes, 33, appeared in the Supreme Court on Wednesday where he applied for bail after being arrested over an alleged shooting incident in Greenvale in June 2021.

He is facing charges of reckless conduct endangering life and discharging a firearm at a premises.

According to Mr Philip Dunn KC for Mr Gunes the case was “circumstantial” and was made up of lots of “triable” points.

It was alleged Mr Gunes was involved in an altercation inside the notorious Love Machine nightclub in early July 2021 before driving to Greenvale to track down one of the other men involved in the altercation.

The prosecution then alleged Mr Gunes shot at the house.

Mr Gunes is also under investigation for a series of alleged fire bombing incidents in which homes and businesses linked to bikies have been set alight across Melbourne suburbs.

Mr Dunn KC told the court Mr Gunes’ father had gastrointestinal cancer and he didn’t have long to live.

His two sisters and mother were all in Turkey taking care of the father but that Mr Gunes was “close” with his father and “should be permitted to go and see him one last time”.

He also said this was Mr Gunes’ first time in custody and he “didn’t like it” and had been “complaining” about not being able to receive panadol when he wanted it.

“This would be a greater incentive for him not to breach bail,” he said.

Mr Gunes was seeking permission to go to Turkey for three weeks.

He had previously been granted permission by the Magistrates’ Court to visit Turkey, which he did and returned in line with his bail conditions.

Mr Dunn KC put forward a number of proposed conditions to help minimise the risk of Mr Gunes being back in the community including a strict curfew, being ordered not to drive and not to attend any licenced premises.

Mr Gunes is also prohibited from possessing a firearm which gives police the power to stop and search him whenever they see fit.

“He has no previous firearm offences, there is an allegation he used one in 2021 but, police have never found a firearm on him or in his home,” he said.

The court also heard Mr Gunes’ family had offered up property assets and large sums of money to assurity.

Justice Elizabeth Hollingworth said there was much to consider and adjourned the matter until Thursday afternoon.
