A “rare night out” in Mildura’s CBD didn’t go to plan for a mother-of-three, who ended up arguing with police after being asked to accompany them to the station.
Renee Mobilio, 40, appeared at Mildura Magistrates’ Court on Wednesday, pleading guilty to being drunk in a public place.
Police said Mobilio was observed on November 30 last year driving a white Toyota Kluger through a closed street.
She was intercepted at the corner of Deakin Ave and Ninth St, where she was required to undergo a preliminary breath test.
The result led police to ask Mobilio to accompany them to Mildura police station for an evidentiary breath test.
Police said Mobilio refused, became “argumentative” and smelled of alcohol.
She was then arrested.
Mobilio’s lawyer said she was enjoying a “rare night out” and had only consumed “three drinks” before the incident.
She was not driving home but instead moving her car away from the timed parking zone where it had been parked.
Mobilio’s refusal to accompany police was related to her being asked to get in a van when the police station was within walking distance, her lawyer said.
Mildura police station is located on the stretch of Deakin Ave between Eighth St and Ninth St.
Mobilio was fined $500, her licence was cancelled and she will be disqualified for driving for two years.
Magistrate Michael Coghlan said Mobilio’s penalty may have been lighter had she consented to the breath test.
“The legal system assumes the worst if you don’t take the test,” Mr Coghlan said.
