Mildura sex pest Maximus Devereux walks free after groping woman, flashing weapons and stashing drugs

A Mildura grub who sexually assaulted a woman, before showing her a knife and gun has avoided further jail time, walking free with time served.

A Mildura sex pest who just wouldn’t take no for an answer has walked away from court a free man after being sentenced to time served.

Maximus Devereux fronted the County Court sitting in Mildura on Tuesday for sentencing on charges related to a wild night out in late 2023.

The court heard on a November night in 2023, Devereux bumped into the victim at Rumours nightclub.

The pair, who had mutual friends, exchanged a hug and went on with their evenings.

Later that night, a friend of the victim gave her and Devereux a ride back to his place.

When in Devereux’s bedroom, he repeatedly asked the victim to have sex with him, and she repeatedly turned him down.

Devereux then pulled the victim back onto the bed so they were lying next to each other and reached his hand up her skirt and touched her on the vagina, over her underwear forcing the victim to push him away.

After the rejection, Devereuxshowed the victim a knife and a gun.

When showing the victim the gun, he told her, “Relax, it is not even loaded,” before pointing it at his own head.

When police searched his bedroom some days after the assault, they found drugs, including the erectile dysfunction drug Spedra and three zip-loc bags containing cocaine.

Previously in court, it was revealed that Devereux entered his plea the day a trial on more serious charges was set to begin, and he was always prepared to plead guilty to the firearms and drugs charges.

The victim’s mother was in court to hear Devereux’s sentence and was crying when Judge John Kelly was reading out a brief summary of the offending.

Before handing down his sentence Judge Kelly spoke about the impact of Devereux’s offending on the victim calling it profound, pointing out that she still suffers flashbacks and her dream of returning to Mildura to start a family one day had been dashed as she can’t bring herself to come back.

“It was a very unsettling performance that understandably disturbed (the victim),” Judge Kelly said.

“I accept that you are unlikely to offend in this way again … If not for your plea of guilty, I would have sentenced you to six months in prison followed by a two year community corrections order .”

Devereux was handed a total effective sentence of three months behind bars, all reckoned as time served, an 18 month CCO and was fined $2000.

He will need to complete 200 hours of unpaid community work as well.
