Mildura GP suspension reversed despite sexual assault charges stemming from extramarital affair.

A Mildura GP, who is facing charges relating sexually assault, has had his suspension overturned and is allowed to continue seeing patients.

A Mildura GP is allowed to continue seeing patients after his suspension was overturned by VCAT despite being slapped with sexual assault charges.

Dr Amil Jockoo originally had his registration suspended by the Medical Board of Australia after he was charged with four counts of sexual assault and two charges of assault with intent to commit a sexual offence.

The married general practitioner, who is also father to a three year old, was charged by Victoria police in June

The accused met the alleged victim at her place of work in March of this year, and after exchanging messages on Snapchat, to avoid them being traced by his wife, the two went on a date, first to a fish and chip shop, then to a viewpoint.

The accusations centre around this extramarital encounter, during which Dr Jockoo allegedly engaged in inappropriate physical conduct, including forceful kissing and aggressive behaviour.

The doctor has denied these allegations, insisting that all interactions were consensual, and that he ceased his actions when asked to do so by the alleged victim on one occasion.

Upon reviewing the details, the tribunal decided against upholding the board’s suspension. It concluded that there was no immediate need to act to protect public health and safety. As such, no immediate action was deemed necessary.

The tribunal emphasised that the accused was presumed innocent until proven guilty, especially as he maintained his innocence and intended to plead not guilty to all charges.

The accused will next face a committal hearing on January 25 at Mildura Magistrates’ Court.
