A Mildura man who took part in an opportunistic smash and grab at a Bendigo department store with a man he didn’t know was hauled out by a bystander and placed under a citizen’s arrest.

Adam Edwards, 24, fronted Mildura Magistrates’ Court from remand to plead guilty to a charge of burglary.

The court heard on the night of March 2, Edwards and another man smashed their way into Myers department store in Hargreaves Mall in Bendigo.

After several attempts by the co-offender to smash the glass doors open, the glass was finally breached and the two men entered the store.

Edwards was pulled out of the store by a member of the public and placed under a citizen’s arrest until police arrived and he was arrested by officers.

The court heard his co-offender was arrested and sentenced to 67 days behind bars on more serious charges.

Edwards, who was wearing rosary beads around his neck, told the court he had never even met the co-accused prior to the night in question.

“I don’t even know the prick, I only met him that night,” Edwards told the court.

Sasha Leon Molina, who was representing Edwards, asked the court for a sentence that would run wholly concurrent with a sentence he was serving for other matters.

Magistrate Patrick Southey sentenced Edwards to jail for his role in the late night smash and grab.

Magistrate Patrick Southey labelled that submission “ambitious”.

“(Edwards) knows what right and wrong is … had you not pleaded guilty it would have been two months in prison,” Mr Southey said.

Edwards was given 30 days behind bars on the burglary charge, 15 days of which will run concurrent with the sentence he is serving on other charges.
