Mildura Bunnings worker Jai Davis fined $4000 for sexual assault

A Mildura grub who slipped into the bed with a woman while she was asleep with her partner and began touching her breasts claims he has no control over what he does when drinking.

A Mildura Bunnings kitchen designer has walked free from court with just a fine despite sexually assaulting a woman who was asleep with her partner.

Jai Davis pleaded guilty to a single charge of sexual assault and was convicted and fined $4000, with Magistrate Patrick Southey saying it was a “drop in the ocean” compared to the damage he had done.

A police prosecutor told the Mildura Magistrates’ Court Davis had been drinking when he went into a bedroom where the victim was sleeping with her partner.

He began touching the woman’s breasts and then asked to see them.

“He apologised for the incident, saying he has no control over what he does when he’s drunk,” the prosecutor told the court.

He was later arrested when the victim pressed charges.

In a victim impact statement read to the court, the woman said the assault had affected her relationship with her partner.

“I get anxious whenever I get woken up by the sheets and I have to calm myself down — I can’t control the tears that roll down my face,” the court heard.

“I feel guilty and shamed that there is nothing I can do.

“(My partner and I) were trying for a baby and now for obvious reasons we’ve had to change to IFV, which is an emotional and financial burden.”

The woman described Davis as “disgusting” and “vile”.

“I’m angry at Jai, he disgusts me,” she wrote.

“I don’t know how someone could do what he did. He’s vile.”

In sentencing Davis, who was supported in court by his father, Mr Southey said the assault was black mark against the Bunnings worker, and that he wanted to make the point to all young men about what happens when you sexually assault a woman.

“It’s a significant stain on his life … it’s a general deterrence and sending a message to all young men that women aren’t just pieces of meat on a smorgasbord,” he said.
