A Mildura man was caught red-handed nicking his housemate’s knickers in an attempt, he says, to get her and her family to move out of the house they were sharing.
The court heard the victim had been suspicious, noticing her underwear and other clothing had been going missing, suspecting her housemate Derek Fox was the person behind it.
Fox, 48, had invited the woman and her family to live in the rental property, but according to the court, he quickly soured on the arrangement and decided to drive them out by swiping their clothes and undies when no one was looking.
After the woman found two pairs of her underwear in Fox’s backpack, she confronted him as he stepped out of the shower. Fox grabbed his backpack and left the house, but police tracked him down a short time later.
Inside the backpack, officers discovered a stash of the woman’s clothing, including multiple pairs of her underwear.
“I was off my head. I went and had a shower, then when I got out she was going off at me,” Fox told police in an interview, the court heard.
Fox’s lawyer Rebecca Boreham claimed her client had been battling a crippling daily meth addiction at the time and was desperate to get his house back to himself.
“(The offending) must have been confronting for the victim,” Magistrate Rose Falla told the court.
Fox has since moved to Ouyen and, according to his lawyer, has gotten clean and turned his life around.
After taking into consideration Fox’s clean record, Ms Fella put him on a three-month diversion plan and ordered to pay the court fund a sum of $100.
