Drunk cursing free-riding train traveller spits on PSO, crafty driver caught and gym boss gets to walk due to 18-month drink drive ban

A backstreet boy who took a wrong direction, a train traveller’s spitting tantrum and a gym junkie’s drink-drive fail were among the cases heard at Moorabbin court this week.

Spitter spat a disgusting end to a birthday party

A drunk 21-year-old who was not happy at being pulled up by PSOs for not buying a ticket tried to spit her way to freedom. The woman and a pal got off the Frankston train at Caulfield station at around 4am on December 23 last year and kicked the travel barriers to get out. Nearby PSOs went to talk to her, but she told them to “f*** off” and “get f***ed” before taking a swing and hitting one of them in the face with her hand. As she was being handcuffed, she spat in the face of a PSO, leaving saliva on his cheek. Police arrived and she was arrested. In court her defence lawyer said she was heavily drunk that night and had problems with alcohol in the past, but was getting treatment and now on the road to recovery. She said she had a very traumatic upbringing and needed mental health and counselling support. She was sent for a community corrections order assessment.

A suspended driver in a car with no plates who took back roads to avoid police is lucky to retain his liberty. The man has a shocking criminal past and served jail time last year, but fortunately for him the driving offences occurred before that sentence, otherwise he would have been sent to prison, a magistrate said. He was picked up by police in August 2016 in Beddoe Ave, Bentleigh East because the car didn’t have any plates. He was also suspended from driving at the time. He told cops he used backstreets to avoid police and was normally successful in not getting caught. His defence lawyer said the long delay in being charged was because his client had “gone missing” due to a chaotic drug lifestyle which the Bentleigh East 43-year-old painter had now recovered from. The magistrate said he was “the luckiest person in the court today” and gave him a 15-month corrections order with 100 hours of community work.

A drink-driver nabbed at almost double the limit while suspended will have to walk to work for the next 18 months. The gym manager and personal trainer was pulled over by police on Waverley Rd in Chadstone at 5am on August 31 this year. He blew .099, and was on a demerit point suspension at the time. He should have been zero as he also has a drug-drive on his record. He was driving a hire car, otherwise the vehicle would have been impounded. He told the court he had a few drinks, but didn’t think he would be over, and was sorry for his actions. The magistrate said this was aggravated offending by driving at double the legal alcohol limit while he was suspended. He was banned from driving for 18 months, convicted and fined $1500.
