A man who removed a condom during sex without his victim’s consent has been convicted.
Diren Duren, 47, was sentenced at the County Court on February 7 to a two-year community correction order after pleading guilty to procuring a sexual act by fraud.
Duren and his victim agreed to have sex at her Port Melbourne home in late 2017.
However, the consensual sex was on the condition he wore a condom.
Duren reluctantly agreed to this condition.
The pair had consensual sex but after a while Duren removed the condom without her consent – an offence known as “stealthing”.
When questioned by the victim, Duren admitted to removing the condom.
The victim then told Duren to leave her house.
She reported him to police later that morning.
Moorabbin Sexual Offence & Child Abuse Team officers launched an investigation the same day.
Investigators recorded a phone call between the victim and Duren in a sting operation to catch Duren out.
Duren admitted removing the condom during the taped phone call.
Duren gave a “no comment” interview after he was arrested on September 27.
His matter was resolved to a plea after a more serious charge was removed.
Judge Trevor Wraight said it was ”self-evident” the victim was upset with Duren’s actions.
“You effectively changed the rules for your own gratification without any consideration for the complainant or her wishes,” he said.
“In my view your offending involved a conscious decision by you and therefore is serious.”
Duren, a forklift driver, came to Australia from Turkey in 2005.

Judge Wraight said general deterrence was the “paramount” consideration for sentencing.
Duren was also ordered to perform 150 hours of community service, and undertake treatment and rehabilitation programs.
Judge Wraight said Duren would have been jailed had he not pleaded guilty.
