A Moorabbin based IT business is being taken to court over allegations it underpaid an employee.
The Backup Bloke Pty Ltd faces a maximum penalty of up to $33,300 and director Paul Loiacono up to $6660 after a full-time salesperson and service technician was allegedly owed 107 weeks worth of unpaid wages between 2015 and 2019.
The Fair Work Ombudsman alleges the underpayment was made due to the employee being paid sporadically and that the worker is also allegedly owed annual leave entitlements.
The ombudsman confirmed the business failed to comply with a compliance notice issued in September, which required management to calculate and back-pay the worker’s outstanding entitlements.
Ombudsman Sandra Parker said Mr Loiacono was allegedly involved in the breach.
“Compliance notices are important tools used by inspectors to deal with apparent contraventions of the Fair Work Act or industrial instruments, most typically modern awards,” she said.
“Where employers do not respond to or comply with these notices, we will take appropriate enforcement action to protect employees.”
