Shepparton man sues Goulburn Valley Health after losing penis to flesh-eating bacteria

A Shepparton man whose penis was amputated after developing a “severe bacterial infection” and flesh-eating disease during a week-long stay in hospital isn’t taking the matter lying down.

A Shepparton patient who lost his penis to flesh-eating bacteria is suing Goulburn Valley Health for allegedly failing to treat him “adequately”.

In a writ filed to the Supreme Court on Monday, Wayne Grundy claimed he developed a “severe bacterial infection” and “necrotising fasciitis” – or flesh-eating disease – on his penis and scrotum area during a week-long stay at the Graham St hospital in April and May of 2018.

The now 70-year-old alleges Goulburn Valley Health “failed to adequately or properly assess the penis adequately or at all” when he presented to the hospital with swollen genitalia.

Among the claims, the public hospital allegedly “failed to administer antibiotics for the first 1.5 days of the treatment” did not “immediately” transfer Mr Grundy to the “Royal Melbourne Hospital or a similar such specialist hospital when the diagnosis of sepsis was made”.

The alleged botched treatment lead to the amputation of his penis, the loss of his left testes and repositioning of his right testes.

Mr Grundy now suffers from post-traumatic stress disorder and “psychological upset together with depression and anxiety”, according to the writ.

The writ claims Mr Grundy “will continue to suffer loss and damage”.

Barbarte Personal Injury Lawyers principal lawyer Carmelo Barbante said while these types of cases were “very rare”, the hospital’s alleged negligence put his client in a “life-threatening situation”.

“They’re serious allegations, and the negligence is absolutely gross,” he said.

A Goulburn Valley Health spokesperson said they were not able to comment as “this matter is the subject of legal proceedings”.

Mr Grundy is seeking costs, damages, interest and other relief which “deems fit”.
