A Kilmore father who hit his then wife in front of their daughter after accusing her of cheating will be released from jail in time for Christmas.
The 46-year-old man, who can’t be named due to legal reasons, was sentenced to time served (124 days) in the Shepparton Magistrates’ Court on Tuesday.
He pleaded guilty to a series of domestic violence related charges including unlawful assault.
Prosecutors told the court the man’s offending started on May 28 this year when he punched his wife in the side of the head as she was getting into bed.
He apologised and said it was an accident because he was sleeping.
The victim believed it was intentional because her husband was angry as he believed she had been cheating on him.
On June 2, while the victim was driving her husband home from shopping, the pair got into an argument over the wife’s alleged cheating.
He then have her a backhand to the temple region while their daughter was also in the car.
The man said he hit the victim there because he knew where to hit people where it would hurt but not leave a mark.
Two days later, the man yelled at the victim about her alleged cheating before she tried to run away.
He kicked her in the backside and lower back saying he didn’t mean to do it that hard.
The next day the victim woke up to her daughter telling her she should look outside and when she went out she found her husband had thrown all of her lingerie over the front yard.
The man’s wife eventually provided a statement to police where she provided a photo of her lingerie and a medical certificate indicating her injuries
In an interview with authorities, the man denied all allegations of his offending and claimed his wife was mentally unstable and lying.
Magistrate David Faram described the man as “controlling, deplorable and violent”.
He said the victim impact statement’s provided to the court by the victim and her daughter were a “difficult read to understand the impact (the man’s) behaviour has had”.
Upon his release, the man will serve a two-year community corrections order.
