A sick rapist who forced himself on a woman as she woke up later tried to explain his vile actions to police with a pathetic excuse.

A Victorian man who cuddled up to a sleeping woman and raped her as she woke up tried to excuse his actions to police by claiming all she said was “no”.

Cody Sumner, 30, was jailed on Thursday for five years in the County Court having earlier pleaded guilty to one count of rape.

Judge Michael McInerney said Sumner penetrated the woman three times in October 2022 after she woke up to find her rapist pulling her shorts and underwear down.

Following the rape, she emailed a friend to say she thought she may have been raped and spoke to her father later that day.

Judge McInerney said the victim also texted Sumner, saying “How could you not know what you did. That kind of s--t can get you in heaps of s--t. I said no and I told you to stop. You continued to do it anyway”.

Sumner replied “‘I am honestly sorry I did it.” He told police that she didn’t back off during the rape. Sumner said all she said was no and that was it.

“Normally someone would pull away and try to get away. That’s what’s confused me,” he told police.

Judge McInerney said Sumner also apologised to the victim’s father, saying “The biggest mistake I’ll ever make, apart from being born but I am honestly sorry.

“If I could take it back what I did, I would. I understand I deserve to end up in a body bag. I know I f----d up big time.”

A psychologist who saw Sumner told the court the latter seemed to have an “impaired empathy” towards the victim and a focus on his own sexual needs.

Sumner must serve a minimum of three years before being eligible for parole.
