Red flags in relationships with domestic violence

A drunken construction foreman bombarded his ex-partner with almost 250 calls over 48 hours, delivering chilling death threats in recorded phone conversations.

Jason Smith, 51, pleaded guilty to a charge of stalking in the Ringwood Magistrates’ Court on Monday.

The court heard Smith, of Scoresby, called his ex partner 246 times over two days, including calling her 50 times during the hour she was at the police station reporting his behaviour.

Smith threatened to kill her multiple times during phone calls the victim recorded.

“I will f--king take you out,” he said in one call.

The victim recorded the phone calls and the chilling recordings were played in court.

“You are f--king dead you understand? F--king dead.”

In another call Smith claimed he would “absolutely f--king smash” the victim.

“You choose everyone over me,” he said in another call.

During this call the victim desperately tried to ask Smith to stop calling her.

“I will do whatever I f--king want,” he said.

“Try and stop me.”

Smith’s lawyer told the court his client was drunk at the time of making the threats and had since sought help for his addiction.

Magistrate Jennifer Tregent told Smith he could not keep offending in this way.

“The relationship did not work out and by your behaviour afterwards that is not surprising,” she said.

“I hope for the sake of your victim you have deleted her phone number.”

Smith was sentenced to a community corrections order which will include community service hours, supervision and a mens behaviour change program.
