A P-plater who failed to see an intersection on an unlit rural road while talking to his front seat passenger collided with a ute in the state’s north, killing a much-loved grandfather.

Riley Camin, 19, was on Thursday sentenced to two years in a youth justice facility due to his age after pleading guilty in the County Court to charges of driving in a manner causing death and dangerous driving causing serious injury.

Camin caused the death of Alexander Eagle, 69, of Shepparton, who was driving a 1999 Toyota utility at the intersection of Dunbar Rd and Lancaster Rd about 10.30pm on January 20 this year.

Judge Davod Brookes said Camin failed to recognise the intersection, breaking heavily about 10m south of it and failed to stop at the stop sign, skidding through the intersection and slamming into Mr Engle’s utility which rolled and came to rest on the driver’s side.

Riley Camin’s friend and front seat passenger was flown to The Alfred hospital with serious injuries following the fatal crash.

Mr Eagle was trapped in his vehicle and was unresponsive having suffered multiple fatal injuries and was later pronounced dead at the scene by paramedics.

Camin and his 18-year-old front seat passenger and friend managed to get out of their vehicle.

His friend was flown to The Alfred hospital and suffered complex trauma that included a ruptured diaphragm, open fracture of the left thigh bone, complex wrist fractures, multiple hand bone and rib fractures, a collapsed lung, bruised heart and damaged spleen and liver.

A visibly distraught Camin spoke to several people at the scene, including police, and said he didn’t even notice the intersection.

“I was just talking to my mate and it came out of nowhere. I slammed the brakes on but it was too late,” he said.

Judge Brookes said although the intersection was known to be dangerous, Camin should have known as he was a local.

Camin is the oldest of three and his family moved to Kyabram when he was younger. He obtained his probationary NSW licence to help with his engineering fabrication apprenticeship which he commenced half way through year 11 and was employed by Ausbuilt Rural. The company told the court it would keep Camin’s job following the completion of his sentence. Camin has been a member of the Girgarre Football Netball Club for many years and was recently made captain of the team.
