A chef who thought he was chatting with a 14-year-old girl who he sent child abuse material to was actually speaking to an undercover cop, a court has heard.

Daniel Wilson, 34, was released on a reconnaisance order after being convicted by the County Court in Melbourne on Wednesday on a raft of charges relating to possession child abuse material.

Judge Paul Higham sentenced him to 19 months on all charges but said Wilson would be released immediately as exceptional circumstances existed that warranted a non custodial sentence.

Wilson made sexually explicit requests and sent two child abuse images during the offending in June and July 2022. He requested an image from the person he was chatting to which was declined. He then sent an image of his genitals. On August 18, 2022 police executed a search warrant and seized two electronic items containing 69 image files.

The County Court has spared a jail sentence to chef Daniel Wilson for possessing and disseminating child abuse material.

The images depicted children from toddlers to teenagers involved in sexual acts.

Wilson admitted owning an iphone but denied possession of child abuse materials or having inappropriate discussions with a child.

Wilson came to Australia in 2018 from New Zealand in an attempt to leave his troubled past behind and was working as a chef when he offended.

Judge Higham said possession and accessing child abuse material were rightly described as “insidious and pernicious” offending for it took place away from the site and physical presence of parents and carers.

The judge accepted Wilson did not make threats or inducements or adopt a different persona despite his user name.

“From the start, you engaged in sexually explicit discussions, you transmitted child abuse material and indecent images of yourself,’’ Judge Higham said.

“You were persistent in your request and encouraged her to masturbate while talking to you. “Every time an image is published or disseminated, it represents a further violation of the child.

“That you were corresponding with an adult police officer does not reduce the objective gravity of the offending, nor does it lower your moral culpability. You had every opportunity to end the conversation but did not.

“Without customers, there will be no market, and that market is based on a fundamental betrayal of our common humanity by the degrading and traumatized exploitation of children and the sexual gratification of others.”

Given Wilson’s offending was at a lower end, his early plea of guilty, genuine remorse, low to moderate risk of reoffending, a lack of prior conviction, strong work history, familial support and uncertainty of deportation, Judhe Higham was prepared to not send him to jail.
