A Melbourne woman who orchestrated the kidnapping of a Saudi Arabian royal who was dragged into a car and threatened into handing over $40,000 in Bitcoin after a Tinder date has been spared jail.
Catherine Colivas, 24, and friend Paris Kennedy, 22, were sentenced at the County Court on Monday over several charges in relation to a burglary and the kidnapping of a Cairnlea man in February 2023, who was then forced to cough up tens of thousands of dollars worth of Bitcoin.
Colivas previously pleaded guilty to kidnapping, extortion with threat to inflict injury and burglary, with Kennedy pleading guilty to burglary and theft.
The victim — who through an impact statement told the court he had since developed “major depression” — watched on via video link.
The court heard Colivas and the man had been on a date when she invited him back to her place in Moorabbin.
But as they approached her home the man was jumped and assaulted by three males who shoved him into a car and took him to an industrial area where they threatened to cut off his fingers and forced him to transfer crypto currency.
In court on Monday, Judge Nola Karapanagiotidis said Colivas played a “major role” in the kidnapping.
“It clearly involved planning, your role was to act as a lure and bait for the victim,” she said.
The court heard Colivas was diagnosed with a borderline personality disorder, with her rehabilitation after the kidnapping described as “remarkable” through her involvement in her local church and receiving mental health help.
Her Honour said these factors as well as youthful age was taken into account in sentencing.
The court heard after the victim was kidnapped, Colivas and Kennedy went to his apartment where they stole designer clothing, a Louis Vutton bag, a PlayStation 5 and several iPhones.
Kennedy also pleaded guilty to a summary charge of handling property proceeds of crime, being the items stolen from the victim’s Cairnlea apartment.
During her plea, the court heard Kennedy grew up in an abusive household with drugs present in Sydney, running away several times and staying in refuge centres before moving to Melbourne for a better life in 2022.
Kennedy spent 90 days at Dame Phyllis Frost centre on remand before she received bail.
In sentencing, Her Honour said both women showed positive prospects of rehabilitation and were low risks of re-offending.
Colivas was convicted and sentenced to a 2.5 year community corrections order, with 240 hours of community work.
Kennedy was also spared jail, receiving a 12-month adjourned undertaking with conviction.
