The identity of a Swan Hill man who allegedly killed a well-known Bendigo artist in an alleged horror hotel bashing has been revealed.
Nodin Peters, 33, faced Bendigo Magistrates’ Court charged with the murder of 34-year-old Josh Penny.
Bendigo detectives charged Mr Peters after Mr Penny died in hospital on January 15 from injuries allegedly sustained during a violent assault at the Heritage Motel in Golden Square on January 2
Joshua Penny died from injuries he suffered in Golden Square on January 2.
Detectives upgraded an initial charge of intentionally causing serious injury to murder after Mr Penny’s death.
At Bendigo Magistrates’ Court on Wednesday Magistrate Trieu Huynh approved an application for police to use “reasonable force” to obtain a sample of DNA from Mr Peters after he refused to comply with the procedure.
Mr Penny’s family wrote in a Facebook post in the aftermath of his death: “It is with broken hearts and unbearable pain that we let you know that due to the severity of Josh’s injuries and deterioration over the last couple of days, Josh has lost the battle he has been fighting.
“His family are devastated and broken and will spend time to say their goodbyes.”
Mr Peters has been remanded in custody and will appear at Bendigo Magistrates Court on May 28.
