A Bendigo man withdrawing from a drug addiction has been charged with rape.

Martin Carbone, 29, faced Bendigo Magistrates’ Court after he was charged on February 14 with a rape that allegedly occured earlier in the year in Swan Hill.

He was refused police bail and was held over the weekend to face a filing hearing on Monday.

Mr Carbone refused to accept services from legal aid, asking for an adjournment so he could be represented by his usual lawyer Daniella Markotich.

He appeared in the dock on Tuesday wearing a black hoody.

He did not make an application for bail.

The court heard Mr Carbone was withdrawing from methamphetamine and GHB.

Magistrate Sharon McRae remanded Mr Carbone in custody ahead of his next court date on May 14 as the committal process begins.
