Korumburra Magistrates’ Court: Brodie Kinniff faces a charge of criminal damage

A boozed-up San Remo concreter who went on a bender to celebrate a mate’s birthday disgraced himself at a Cowes hotel.

A drunken San Remo concreter had too many drinks at a Cowes pub where he abused staff, entered the bistro kitchen and broke plates and bowls.

Brodie Kinniff, 28, pleaded guilty at the Korumburra Magistrates’ Court on Thursday to one charge of criminal damage.

The court heard Kinniff had been drinking and went to the North Pier Hotel in Cowes to celebrate a mate’s birthday at 5.30pm on June 7 last year.

The father, who continued to drink at the pub, was making loud comments and verbally abusing staff.

At 9.15pm, the bar staff called last drinks due to his behaviour.

Kinniff and two other men were walking out through the bistro area where Kinniff entered the bistro’s kitchen, took a stack of plates and bowls and took them to the reception area.

Kinniff was asked to return the items but then said “f--k you what are you going to do about it”? held the plates and bowls in front of him and dropped them.

The court heard when police arrived the hotel manager said Kinniff was a regular at the pub, and was usually very respectful to the bar staff.

Kinniff was arrested and interviewed at the San Remo police station and admitted to being drunk, but was unsure on how much he had to drink and couldn’t remember being at the North Pier Hotel that day.

When asked by police why he took the crockery and broke them, he told them he didn’t remember that either.

Magistrate Suzette Dootjes said it doesn’t sound like regular behaviour for Kinniff.

Kinniff told the court he doesn’t go down there anymore, had moved away from the area and started a mental health plan.

“I haven’t been down there since that incident — it’s a little bit embarrassing,” Kinniff said.

He said drugs and alcohol had been a major effect on his life, had put his head down, been working and staying out of trouble.

“You’ve got a lot to motivate yourself to change,” Ms Dootjes said.

“The fact that they put up with it for a while over that period of time that you were at the hotel, that sort of demonstrates that it was out of character and it must have been pretty distasteful for them.”

Ms Dootjes was aware Kinniff was remorseful and sorry for his behaviour.

“You’re doing something about what led to that kind of behaviour,” Ms Dootjes said.

Ms Dootjes fined Kinniff $650 with a conviction and will pay compensation to the North Pier Hotel in the sum of $50.
