A man who fired a gun through a bedroom door narrowly missing a victim on the other side has pleaded guilty to swag of charges with a co-accused over the terrifying home invasion

Kane Austin and Ronald Allen, both 24, appeared in the Latrobe Valley Koori Court on Monday where they plead guilty to offences including home invasion, possessing a firearm, using a firearm in a public place and intentionally damaging property.

Austin was also charged with theft and Allen faced nine charges of possessing a drug of dependence and charges of conduct endangering life.

The court heard Austin attended the victims’ house in Sale on June 10 last year, who were known to both Austin and Allen, over the sale of a gift card.

After the sale had been completed Austin walked away from the Howard St property before quickly returning.

One of the victims returned to the door where she spoke to Austin as he tried to pawn a necklace and asked to borrow money.

As the victim walked back inside the house to speak with the other victim. Austin covered the doorbell camera with his hand.

CCTV footage then showed Allen entering the house, carrying a firearm towards the bedroom with Austin entering shortly after, picking up a knife from the kitchen counter.

The court heard one of the victims was inside the bedroom and closed the door as Austin and Allen approached.

Austin and Allen then kicked the door, before began rummaging through property in the lounge room, disconnecting the CCTV and taking the hard drive.

He also stole clothing and a duffel bag.

While Austin was rummaging through the lounge room, Allen left the house and approached the bedroom from an external sliding door.

He knocked on the door while pointing the gun.

Allen then went back inside the house continuing to kick the door, trying to get inside the bedroom, before firing the gun twice through the bedroom door.

The victim was pushing his body weight against the other side of the bedroom door at the time of the shots and the court heard he only narrowly avoided being shot in his left shoulder.

Judge George Georgiou said he was “lucky” it didn’t do more damage.

One of the victims fled the property, barefoot she ran down the road before being stopped by Allen who held his firearm up to her and demanded she stop.

The court heard Allen said, “stop or I will blow your f****** head off.”

She then ran to a neighbour’s house to call the police.

When police arrived they were unable to find the men.

Allen was arrested on High St in Dandenong the next day and a mobile phone was sized which had pictures and videos of him and Austin holding and shooting firearms, including a video of Allen shooting a gun out of a moving car.

Austin was arrested days later.

The men will return to court at a later date for sentencing.
