Court proceedings against a man charged with dangerous driving causing the death of a road worker have been adjourned as the prosecution considers discontinuing the case against him.

In brief proceedings in the Ballarat Magistrates’ Court on Thursday, prosecutor John Weigl sought an adjournment in the case against Lucas man David Hastings.

He said the prosecution had received an application for discontinuance and needed time to consider it.

It is the latest complication in the case, which first appeared in court last year.

Hastings is charged with causing the death of a 59-year-old Creswick man on the Western Highway at Trawalla on October 21, 2020.

The man had been parked in the on-camp to the freeway and was setting up for traffic control duties when he was struck.

It has been alleged Hastings stopped his car and tried to help the man before calling Triple-0 but he could not be saved.

The case will return to court in August.

Hastings’ bail was extended.
